ALITO V. GINSBURG -



Alito is in. By a vote of 58 to 42 the Senate confirmed Samuel Anthony Alito Jr. as the 110th US Supreme Court justice on Tuesday afternoon. While his confirmation was not cut as close as Clarence Thomas' 52-48 Senate vote in 1991, Alito still parted the partisan sea with a sharp blade. Alito only snagged 4 Democrat votes to Thomas' 11. The comparison I want to make today, however, is not with Clarence Thomas. I would like, instead, to compare Alito's confirmation process with that of Justice Ruth Bader Ginsburg, who is regarded as the most liberal justice on the current Supreme Court. Here are a few facts broken down:

Alito served 16 years on a US Appeals Court, Ginsburg served 13
Both received a unanimous "well-qualified" rating from the American Bar Association
During the confirmation hearings Alito was asked 759 questions over 18 hours, of which he declined to answer 43. Ginsburg was asked 275 questions over 17 hours, and declined to answer 59.
The number of days that passed between Alito's nomination and his confirmation was 92, for Ginsburg it was 49.
In the Senate Alito received 58 yeas and 42 nays, Ginsburg received 96 yeas to 3 nays.
It is interesting to note a few things about these two former nominees and how they were treated during their confirmation process. Both served over a decade on a US Appeals Court - and therefore had a significant judicial history to review - and both were nominated to replace justices with judicial philosophies quite different from their own.

The Justices They Replaced

Alito is filling the seat of Sandra Day O'Connor who, while a Reagan appointee, showed a tendency to swing toward the left in important cases. In Kelo v. New London (2005) Justice O'Connor upheld the right of a city to confiscate private property for private development. She sided with the majority in Lawrence v. Texas (2003) to overturn state anti-sodomy laws. She decided with the majority that a woman did not have to inform her husband before obtaining an abortion in Planned Parenthood v. Casey (1992).

Alito promises to be far more conservative in his judicial philosophy than O'Connor, as demonstrated by his history on the Third Circuit. In fact, Alito ruled in favor of spousal notification at the appeals level in Planned Parenthood v. Casey. He upholds a literalist interpretation of the Constitution far closer to Justice Antonin Scalia's judicial philosophy than to Sandra Day O'Connor's.

Ginsburg, on the other hand, took over for retiring Byron White. White, while a faithful Democrat, had taken the conservative position in many important cases. He opposed the concept of "substantive due process", which conservative jurists like Scalia currently reject. In Bowers v. Hardwick (1986) White upheld Georgia's anti-sodomy law. In Runyon v. McCrary (1976) he argued that private institutions could legally discriminate based on color, (black or white) defending the right of private groups to choose their membership. He famously joined with William H. Rehnquist to dissent in Roe v. Wade, disagreeing with the legalization of abortion based on a right to privacy.

Unlike White, Ginsburg is considered the most liberal justice on the Supreme Court. She defends her willingness to consult the logic used in foreign courts to make decisions about American legal cases. She interprets the US Constitution loosely while upholding the concepts of substantive due process and the Constitution as a "living" document.

The Point?

The voting history of both Alito and Ginsburg were known at their confirmation hearings. Both were nominated to replace justices whose judicial philosophies differed from their own, and so promised to either make the Supreme Court more liberal or more conservative. Yet, a Republican-dominated Senate confirmed Ginsburg 96-3 in 1993 with little fuss. Alito, on the other hand, divided the Senate nearly down the middle in a 3-month-long, hotly debated and heavily covered confirmation process.

Are the Republicans less inclined to fight for conservative values than the Democrats are willing to fight for liberal causes, or do they just respect the President's freedom to choose well-qualified judges of his own liking? Should conservatives be more tenacious about the values of their constituencies, or are certain liberal Senators just power hungry? Either way, it seems that a conservative judge is more likely to be given a hard time during the confirmation process than a liberal judge.

Yet, Samuel Alito has been confirmed, and will take his seat on the Supreme Court. Extremely important cases await him, from the battle over the words "under God" in the Pledge of Allegiance to three challenges to the federal partial birth abortion ban. In cases such as these, Judge Alito's vote will have a profound effect on the outcome.
